Why does Labour want the new TUPE Regulations annulled, and what will this mean?

We were about to blog in more detail about the new TUPE Regulations, which will make life a lot easier for employers. However, we have had to ‘hold the presses’ because the Labour Party has tabled a parliamentary motion calling for the annulment of the Regulations. Labour object to the fact that they make it easier to cut pay and conditions for transferring employees.

A number of the new rules came into force on 31 January 2014. An annulment would mean that the new rules would have had no effect at all, and that employers may have unwittingly broken the law by relying on them.

This would obviously be a bizarre result and we don’t expect Labour’s motion to be successful. We will, however, keep you posted.
